Can the one, who is divorced for the purpose of "fornication", remarry when their now "old" spouse dies (Romans 7:1-3)? Does the death of a spouse give eligibility to remarriage, no matter what the circumstance (even in the case of unscriptural divorce)? Thank You

Remarriage is only forbidden in a few cases.
As such the divorced person CAN remarry whether the ex spouse is living or dead.

This guilty vs innocent thing is entirely bogus and completely removes grace for the repentant person who may have done wrong in their marriage.
Divorce is divorce is divorce.
Once divorced then BOTH parties are no longer under the law of marriage.

It is important to take what any man says pertaining to any subject in accordance with the scriptures. A lot of opinions may be trown around, but this does not obligate us to follow them. We should follow God and not man.

There are very few reasons for divorce scripturally, Jesus said that originally God did not permit divorce, in the O.T. when a women was worthy of seperation she was killed. I am not sure at this point what a mans obligation was when he was unfaithful, but we can be sure that he would answer to God.

Just becasue the civil government accepts things as they see it, does not make it what God calls it. Jesus said:
Matt 19:4-9

4 And He answered and said to them, "Have you not read that He who made them at the beginning 'made them male and female,' 5 and said, 'For this reason a man shall leave his father and mother and be joined to his wife, and the two shall become one flesh'? 6 So then, they are no longer two but one flesh. Therefore what God has joined together, let not man separate."

7 They said to Him,"Why then did Moses command to give a certificate of divorce, and to put her away?"

8 He said to them, "Moses, because of the hardness of your hearts, permitted you to divorce your wives, but from the beginning it was not so.9 And I say to you, whoever divorces his wife, except for sexual immorality, and marries another, commits adultery; and whoever marries her who is divorced commits adultery."
NKJV

Some think that the guilty party cannot remarry once put away, I still have mixed feeling about this, I have not worked through it, but Jesus said that the offended party can divorce, but He said nothing about the other.

I guess the point is this: God does not like divorce, from the beginning it was this way, Moses through the will of God apparently allowed the certificate of divorce, then Jesus tells us exactly what the situation is.

When we divorce unscripturally just because the government says its ok , does not make it ok.

Death is what should seperate a couple, but obviously Jesus saw something in adultry, fornication that was worthy of divorce.

Now for the guilty party, repentance and restitution should be their focus, not getting hitched to someone else, we are talking about a Christian, who should upon repentance work fruits worthy of repentance, which means something other than finding another spouse. Getting yourself right before God should be priority.

Even though Jesus said the stipulation was adultry, fornication, that does not mean that forgiveness cannot be brought forth to those who are truly sorry and repentant.

The two shall become one.

Very good post, JSM17.

I think there is a very good harmony in scripture that shows just how holy the marriage covenant is to God.
Holy so that He does not want it to be ended but to be for a lifetime; and holy so that He tolerates it being ended if the breach is extreme enough.

What is sad is when some doctrinal views make an idol of the covenant itself, while making the persons in that covenant meaningless and thus expendable.

These teachings have missed the entire point of the scriptures, just as the pharisees did who put the sabbath above the men and women for whom the Sabbath was created.
